6. Charges

6.1 Charging principles

Cf. Allocation Regulations Ch. 4, Annex 1.3.

Access charges shall be set at the marginal cost.

Initially the price shall reflect the socio-economic short-term marginal cost, but it is adjusted relative to how the diesel tax reflects the corresponding costs of road traffic.

The amount to be invoiced is arrived at by multiplying the price by a factor that reflects the individual train’s weight and/or mileage.

There are exceptions to the above, as follows:

Regarding the Gardermobanen Line (stretch Etterstad-Gardermoen), the Storting has decided that the price on average shall cover all costs regarding operation and maintenance of the infrastructure of the line.

No scarcity charge 1) is calculated for allocating infrastructure on lines with little available capacity in this period.

Any environmental charges 2) are currently included in the minimum access packet charge. NNRA does not require any extra environmental charge for any stretch of track during this period.

Other environmental charges may be included (camouflaged) in prices for fuel, etc.

No discounts 3) are implemented. Cf. Network Statement Ch. 6.4

No reservation charges 4) are required during this period.

NNRA provides other services which are not covered by the minimum access package charge.

6.1.1 Minimum access package

Cf. Allocation Regulations § 4-1 and Annex 1 section 2, Annex 1.3.

The minimum access package is priced according to marginal costs, cf. above.

The minimum access package includes traffic control. In this context, traffic control is also considered to cover communication between trains (locomotive drivers) and the traffic control centre/traffic controllers at stations (on non-remotely-controlled lines), using GSM-R phones. (Other uses of GSM-R phones are prices as additional services, cf Ch.s 6.1.4 and 6.3.4.)

Any costs linked to (manning of) traffic control at stations on lines without line block (non-remotely-controlled lines, cf Network Statement, Ch. 3.2.3) in conjunction with operating ordinary trains as well as extra trains, are also covered by the minimum access package. The RUs must not be billed for this service.

6.1.2 Access to facilities referred to in 5.3.1

Access to systems specified in Network Statement Ch. 5.3 is priced according to marginal costs as is the case of the “minimum package”.

6.1.3 Services referred to in 5.3.2

Cf. Allocation Regulations § 4-2 and Annex I, section 2, Annex 1.3.

Services that are prioritised are priced at full cost, i.e. full cost including return on the capital.

6.1.4 Additional services

Cf. Allocation Regulations § 4-3 and Annex I, section 3 - Annex 1.3.

Additional services that are provided by NNRA are priced at market terms.

6.1.5 Ancillary services

Ancillary services that are provided by NNRA are priced at market terms.

6.2 Charging System

Cf. Allocation Regulations Ch. 4 and EU Dir. 2001/14/EC Article 7 (2) - Annex 1.3. There is only one price for the ”minimum access package”.

Exception: The Gardermobanen Line (The stretch Etterstad-Gardermoen), where the price for the use of Gardermoen Line is in addition to the price of the “minimum package”.

Formula for the calculation of the Amount to be billed for Freight Transport.

The amount to be invoiced = price x produced gross ton km.

The number of gross-ton km is calculated independently of the type of train and/or wagon.

Formula for the calculation of the Charge for the use of the Gardermoen Line.

The Gardermobanen Line is the line from Etterstad to Gardermoen.

Charge = price x ordered train-kilometres

The number of train-kilometres is calculated on the basis of the number of kilometres that the train has covered regardless of the train’s length, the number of wagons, etc.

Ordered train-kilometres are calculated on the basis of allocated infrastructure capacity during the different timetable changes. The price is decided by the Norwegian Parliament during the annual budget.

The charge for use of the Gardermobanen Railway Line is in addition to the minimum access packet charge and applies to all trains on this line.

Basis for calculation when Freight Wagons for combined Transport and ordinary Wagonload are included within the same Train

When freight wagons for combined transport and ordinary wagonload are included within the same train, the gross weight of the locomotive shall be included in the basis for calculation with the same percentage as the ratio between the gross weights of the two different types of freight.

Example: The gross weight of the train (excl. the locomotive) is 1000 tons, of which the gross weight of the combined transport with appurtenant wagons constitutes 60 %, and the gross weight of the wagons for wagonload constitutes 40 %. In this case, 40 % of the weight of the locomotive shall be included when calculating the number of gross-ton km.

6.3 Tariffs

All tariffs pertaining to the use of the infrastructure is set in connection with the State Budget in October each year, i.e. 2-3 months before the new tariffs are valid. All tariffs are without VAT. From 01.01.2005 NNRA invoice with VAT.

6.3.1 Minimum access package

Charge for the Use of specially Constructed Infrastructure

Special Tariff for All Train Transport on the Gardermoen Line (between Etterstad and Gardermoen)

The tariff for the use of the Gardermoen Line shall cover all NNRA`s costs connected to the operation and maintenance of this stretch.

Invoicing the use of the Gardermoen Line is based on planned train operations, i.e. the amount of train kilometres that the Railway Undertakings are offered during the Capacity Allocation process.

6.3.2 Track access to service facilities

Track access to service facilities is included in the minimum access package. The prices are the same as for the minimum access package - see section 6.3.1 above.

6.3.3 Supply of services referred to in 5.3

Charges are agreed between the parties.

6.3.4 Additional services

Charges are agreed between the parties.

When services are sought by or offered to several parties, NNRA will set tariffs and publish these on its website. Examples of such services are:

  1. GSM-R used for purposes other than traffic control.
  2. Hire of train preheating facilities
  3. New establishment of train preheating facilities

6.3.5 Ancillary services

Charges are agreed between the parties.

6.4 Performance scheme

Cf. Allocation Regulations § 4-2 – Annex 1.3.

Performance schemes have so far (per November 2014) not been implemented on the national railway network.

6.5 Changes to charges

Cf. Allocation Regulations § 4-1: “The Ministry sets the rates for infrastructure charges and the specific rules for these charges” - Annex 1.3.

The infrastructure charges are normally set in connection with the Government`s presentation of the annual state budgets towards the Parliament. The basis for changes to the charges is mainly founded in the annual price regulation of the State Budget.

To the extent that changes to the dimensioning of the infrastructure charges are likely to occur, this will be subject to a separate parliamentary decision.

6.6 Billing Arrangements

Cf. Allocation Regulations § 4-4, and EU Dir. 2001/14/EC Art. 4 - Annex 1.3. NNRA bills for all services.

Billing occurs on the 15th every following month.

The RUs are obligated to provide the necessary information for calculating the value of the service. If RUs do not deliver the required information, NNRA may decide upon the value based on its own judgement.

When the invoice is based on reporting from the railway undertaking, the Norwegian National Railway Administration may request the basis documentation for the report.

NNRA can establish more detailed guidelines for billing.

Information that all RUs are required to provide

For all trains, the train’s gross weight shall be reported regularly. A filled out train consist, (cf. TJN Ch. 4 and ADR/RID 2015 - Annex 1.3) is regarded as satisfactory reporting.

The train consist shall be submitted in electronic format.

Terms and Conditions (including Non-payment)

Payment shall be made within 30 days. An interest on arrears is charged for overdue payments.

In response to non-payment, NNRA, after a written notice, may withdraw the allocated train path.
